CITY OF MORENO VALLEY ADOPTION OF THE CITY OF MORENO VALLEY RENEWABLE ENERGY PROCUREMENT PLAN BY THE COUNCIL OF THE CITY OF MORENO VALLEY ON JUNE 11, 2013 NOTICE IS HEREBY GIVEN, that on Tuesday, June 11, 2013, at 6:00 PM or as soon thereafter, at the Council Chambers, City Hall, 14177 Frederick Street, Moreno Valley, California, the Council of the City of Moreno Valley will consider the adoption of the City of Moreno Valley Electric Renewable Energy Resources Procurement Plan pursuant California Senate Bill 1X-2. Senate Bill 1X-2 establishes a Renewable Portfolio Standard of 33 percent by 2020 for all load serving entities in California. This extends to the City of Moreno Valley Electric Utility, a publicly owned utility. SB 1X-2 establishes minimum quantities of renewable energy resources that load serving entities must procure annually through 2020. Each load serving entity covered under the new law, including City of Moreno Valley Electric Utility, is required to develop and implement a Renewable Energy Procurement Plan that describes how the City will achieve its RPS procurement requirements. The proposed RPS Procurement Plan will be posted along with the City Council Agenda 72 hours prior to the City Council meeting at http://www.moval.org/city_council/agendas-sire.shtml Members of the public may address the City Council regarding the item in this notice. NOTICE OF INTENTION TO APPLY FOR ORDER DECLARING STATUS OF NEWSPAPER AS ONE OF GENERAL CIRCULATION [GOV. CODE SECTION 6021] SUPERIOR COURT FOR THE STATE OF CALIFORNIA FOR THE COUNTY OF RIVERSIDE CASE NUMBER RIC 1305730 In the Matter of the Petition of JEANNIE GOODMAN to Have the Standing of THE PRESS-ENTERPRISE as a Newspaper of General Circulation Ascertained and Established: NOTICE IS HEREBY GIVEN that on June 24, 2013, at 8:30 am, or as soon thereafter as the matter may be heard in Department 12 of the above-captioned court, located at 4050 Main Street, Riverside, California, Petitioner intends to apply for an order declaring the newspaper known as The Press-Enterprise to be a newspaper of general circulation for the City of Perris. The Petition sets forth the following: Petitioner, Jeannie Goodman, alleges: 1. I am a manager of the newspaper known as the Press-Enterprise ("Newspaper"). The following facts are true of my own knowledge, except as to those matters which are stated on my information and belief, and as to those matters, I believe them to be true. 2. The Newspaper is a newspaper of general circulation published for the dissemination of local or telegraphic news and intelligence of a general character throughout the County of Riverside, State of California. The business address is 3450 Fourteenth Street, Riverside, California, 92501. 3. The Newspaper has been published since 1878 in the geographic area now known as Riverside County in the State of California. Since 1878, the Newspaper has not made any substantial change in its character as a newspaper of general circulation. 4. In 1923, the California legislature enacted Political Code section 4465, now codified as Government Code section 6006. This section provides that a newspaper that met the requirements for adjudication as a newspaper of general circulation in place before enactment of Political Code section 4465 in 1923 may be adjudicated as a newspaper of general circulation notwithstanding changes in relevant statutory law. 5. As of 1923, when Political Code section 4465 was enacted, the Newspaper was regularly published daily, excepting Sundays and holidays, in the City of Perris in that the Newspaper was circulated and distributed to a bona fide subscription list of 35 residents within the City of Perris. 6. Furthermore, Government Code section 6006 was interpreted by the California Supreme Court in the case of In re Norwalk Call (1964) 62 Cal.2d 185, 189-190 to mean that a newspaper that met all requirements as a newspaper of general circulation for a county before 1923 automatically becomes a newspaper of general circulation for any subsequently incorporated cities in that county. 7. On information and belief, the City of Perris ("Perris") was incorporated within the County of Riverside in 1911. 8. At the time of Perris's incorporation in 1911, the Newspaper was regularly printed and published daily, excepting Sundays and holidays, in the County of Riverside, with a bona fide subscription list of paying subscribers within the County of Riverside. WHEREFORE, Petitioner prays for judgment ascertaining and establishing the Press-Enterprise as a newspaper of general circulation, as defined in Government Code § 6000, for the City of Perris.
